2. The petitioners are apprehending their arrest in connection with Tiyar P.S. Case No. 58 of 2023 registered for the offence punishable under Sections 30(a), 30(d) of the Bihar Prohibition and Excise Act.

3. After some argument, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as

Patna High Court CR. MISC. No.66585 of 2023(3) dt.22-01-2024 2/2 withdrawn.

6. However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order.
