The Vice-Chancellor of the university will examine the claim of the petitioner, for which he had been moved in terms of Annexure-2 to the writ application. The Court is constrained to record that it is because of complete apathy on the part of the university authority that such litigations are generated. Counsel for the university on instruction informs the
Patna High Court CWJC No.12948 of 2015 dt.13-07-2017 2/2 Court that a sum of rupees six lacs and odd has already been authorized and the petitioner can either collect the same or authorized somebody to collect it on his behalf as he is supposed to be bed-ridden.
The university authorities have an obligation to also provide a detailed break-up of payment, which has been authorized in favour of the petitioner for payment. They will also have an obligation to verify other claims, which have been raised in Annexure-2 and certify that they are either payable or not payable to the petitioner. All this must be done within a period of three months from today. Failure to comply with the order will entail consequences for the Vice-Chancellor.
Writ application stands disposed off with observation / direction as above.
This order has been passed in the background that no counter affidavit has been filed on behalf of the university in the last two years.
