2. The petitioner has preferred this application for grant of regular bail in connection with S.Tr. No. 101 of 2025 arising out of Korma P.S. Case No. 02/2025 dated 04.01.2025 registered for the offences punishable u/s 103 and 61 read with Section 3(5) of the B.N.S. and Section 27 of the Arms Act
3. As per the prosecution case, the petitioner and the co-accused persons came to the house of the informant holding lethal weapons and started abusing the informant's husband. In the meantime, the petitioner and the co-accused person, Ajit Yadav open fire upon the husband of the informant causing
Patna High Court CR. MISC. No.62882 of 2025(2) dt.24-09-2025 2/3 injury on his stomach. Thereafter, he was taken to hospital where the doctor declared him dead.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case on account of land dispute. The petitioner has no concern with the alleged occurrence. As per Annexure 2 and 3, P.W.1 (informant) and P.W. 2 in their deposition have stated that the petitioner and the co-accused, Ajit Yadav fired on Nandan Yadav, but the bullet fired by the co-accused, Ajit Yadav hit her husband's stomach and the bullet fired by the petitioner hit the wall. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 25.02.2025.
5. Learned A.P.P. for the State as well as learned counsel for the informant have vehemently opposed the bail petition of the petitioner by submitting that the specific allegation of firing is against the petitioner and the co-accused person, Ajit Kumar.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
Patna High Court CR. MISC. No.62882 of 2025(2) dt.24-09-2025 3/3 concerned, Sheikhpura in connection with S.Tr. No. 101 of 2025 arising out of Korma P.S. Case No. 02/2025 with the condition:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled.
7. The application stands allowed.
