====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-10-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioners apprehend their arrest in connection with Kishanganj P.S. Case No. 319 of 2017 registered under sections 147, 148, 149, 323, 332, 353, 427, 504 of the I.P.C. The allegation against the petitioners is that the petitioners along other accused persons blocked the Gachhpara Tengarmari Chowk and destroyed the vehicles lying on the road. Learned counsel appearing for the petitioners submits that the petitioners have not committed any offence in the manner alleged and the petitioners are running a shop near the place of occurrence and the allegation against the petitioners

Patna High Court CR. MISC. No.62074 of 2019(2) dt.18-10-2019 2/2 and 40 to 50 persons are general and omnibus in nature. Having regard the submission made by the parties and taking into consideration the fact that nobody sustained injury during blocked of the road and the petitioners have got no criminal antecedent, I am inclined to grant anticipatory bail to both the petitioners.

Accordingly, the petitioners, above named, in the event of arrest or surrender before the learned Court below within a period of four weeks from today shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 319 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
