2. The petitioner seeks bail in connection with Kinjar P.S. Case No. 165 of 2023 registered for the offence under Sections 395 of the I.P.C.
3. The petitioner is not named in the F.I.R. and are in custody since 12.03.2025.
4. As per FIR, while informant was going with his paddy laden truck to Shri Balaji Digital Dharamkanta, Kurtha he was overtaken by a Bolero car and was signaled to stop. It is further alleged that unknown miscreants forced informant and his driver to step into their Bolero car and thereafter they were dropped at

Learned counsel appearing on behalf of the petitioner submitted that the name of this petitioner transpired on the basis of confessional statement of coaccused Ravi Kumar, in furtherance of which no incriminating material recovered/ surfaced which may connect this petitioner with present occurrence of dacoity. It is pointed out that even co-accused Ravi Kumar, who named this petitioner was granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 53543 of 2025 dated 22.08.2025. While explaining criminal antecedents, it is submitted that petitioner found involved in four more criminal cases where he is on bail and moreover, investigation of this case is already completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
6. Learned APP opposes the prayer of bail.
7. In view of aforesaid factual submission and by

No.62544 of 2025(2) dt.30-10-2025 3/3 taking note of fact as save and except suspicion arising out of confessional statement of co-accused as discussed aforesaid prima-facie nothing incriminating appears during investigation, suggesting involvement of petitioner, who remains in custody since 12.03.2025, accordingly petitioner above named, is directed to be released on bail in connection with Kinjar P.S. Case No. 165 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Arwal /concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C/ Section 480(3) of BNSS.
