1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Pibahore Police Station Case No. 234 of 2024, disclosing offences under Sections 420, 467, 468, 120(B) of the Indian Penal Code.
3. As per the First Information Report, on 27.03.2024, co-accused Akash Kumar with his counsel Satish Kumar and Pratik Kumar called the informant in the Court of learned Sub Divisional Judicial Magistrate, Sadar Court, Patna and got signature of the informant in a compromise petition. It has further been alleged that both the accused persons along with co-accused Akash Kumar are involved in conspiracy and prepared a forged compromise petition in furtherance of the same.
4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case by the police with oblique motive. Upon perusal of the First
Patna High Court CR. MISC. No.66910 of 2024(2) dt.03-10-2024 2/2 Information Report, it would be clear that there is no allegation against the petitioner and the petitioner has only been made accused on the basis of fact that he happens to be the father of co-accused Akash Kumar.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Pibahore Police Station Case No. 234 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
