JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Manihari P.S. Case No. 238 of 2019 registered for the offences punishable under Sections 147, 148, 323, 307, 447, 379, 504 and 506 of the Indian Penal Code.

Allegation as per FIR is that on the order of petitioners entered into the house of the informant and petitioner No.1 set fire on the body of informant, causing burn injuries to her and petitioners are named in the FIR.

Submission of learned counsel for the petitioners is that no specific allegation has been attributed against the petitioner except petitioner No.1 and they have falsely been implicated and other co-

Patna High Court CR. MISC. No.58841 of 2019(2) dt.18-09-2019 2/2 accused persons have been granted bail by the court below itself. Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioners stating that there is allegation against them in the FIR.

In view of above facts and circumstances, let petitioner Nos. 2 to 4, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Manihari P.S. Case No. 238 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.

So far petitioner No.1 is concerned, his prayer for anticipatory bail is rejected. He may surrender and pray for regular bail.

With the above observation, this application is disposed of.
