The petitioner apprehends his arrest in registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

1123.56 litres of illicit liquor has been recovered from Bolero vehicle of which this petitioner is registered owner. It is submitted that nothing has been recovered from conscious possession of this petitioner. Petitioner is not the owner of vehicle in question. During course of investigation it has come that one Mukesh Pandey is the owner of the vehicle in question.

Considering the submission made on behalf of petitioner, this petition is disposed of with direction to the

Patna High Court CR. MISC. No.63783 of 2022(3) dt.22-12-2022 2/2 learned court below to verify the ownership of the vehicle in question. If after verification, it is found that the petitioner is not owner of the alleged vehicle he shall be enlarged on bail on usual terms and conditions as may deem fit and proper.
