JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-01-2023 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned counsel for the informant.
The petitioner apprehends his arrest in connection with Babubarhi P.S. Case No. 73 of 2021, registered for the offences punishable under Sections 406, 409, 420, 467, 468, 471, 120B of the Indian Penal Code.
As per allegation, the accused persons did not complete the work of Nal-Jal scheme despite they have received amount against that scheme.
Learned counsel for the petitioner has submitted that the petitioner is merely an agent-cum-supplier of the hardwares and he
Patna High Court CR. MISC. No.1627 of 2022(7) dt.03-01-2023 2/2 has supplied the required hardware and in this respect the Mukhiya has issued a certificate which is annexed as annexure-3. On the other hand, learned counsel for the informant has opposed the prayer for bail.
Annexure-3 is certificate issued by Mukhiya Gram Panchayat, Kulhariya which shows that the petitioner has completed the entire work against the money refunded to him. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Madhubani in connection with Babubarhi P.S. Case No. 73 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
