The petitioner seeks regular bail in connection with Goraul P.S. Case No. 493 of 2020 lodged under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2018. As per the allegation, the total recovery of 412.920 litres of Indian made foreign liquor was made from the vehicle parked in a school.

Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner. He further submits that charge sheet has already been filed in this case and the petitioner is in custody since 27.09.2021. Learned counsel further submits that there is one case pending of similar nature against the petitioner in which he is on bail. Learned

Learned A.P.P. has opposed the prayer for bail. Considering the facts that charge sheet has already been filed in this case and petitioner is in custody since 27.09.2021, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Act, Vaishali in connection with Goraul P.S. Case No.493 of 2020. The petitioner is directed to file an undertaking before the Trial Court that he shall not involve in such type of activities in future at the time of furnishing bail bonds. The prosecution is at liberty to file cancellation of bail of this petitioner, if he found to involve in such type of activities again.
