JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 341, 307, 504, 506, 34 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act. The prosecution case is that on 22.03.2015 at 4:00 P.M due to the dispute with regard to playing cricket, all the accused persons came at the door of the informant, abused by calling caste name and assaulted the informant. It is submitted by learned counsel for the petitioner that accusation is omnibus and general and for a petty dispute the accusation has been levelled. It is further submitted that other co-accused have been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 39593 of 2015 and Cr. Misc. No. 728 of 2016. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.6550 of 2016 (2) dt.11-02-2016 2/2 petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Piro P.S. Case No. 95 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, Bhojpur at Ara. With the observations above, the application stands disposed off.
