JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-03-2020 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel for the complainant/opposite party no.2.

The petitioner seeks pre-arrest bail in connection with Complaint Case No.764 of 2018 in which cognizable has been taken under Sections 498A & 323 of the Indian Penal Code. It is contended by the learned counsel for the petitioner that there is no truth behind the allegation that the petitioner ever subjected the complainant to cruelty. The instant case has been registered due to matrimonial discord and

Patna High Court CR. MISC. No.59805 of 2019(3) dt.04-03-2020 2/2 incompatibility between the parties.

On the other hand, learned counsel appearing for opposite party no. 2 submitted that the allegation made in the complaint are fully supported by the complainant in her statement made on oath.

Regard being had to the nature of allegation, in the event of arrest or surrender before the court below, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Vaishali at Hajipur in Complaint Case No.764 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
