JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 Petitioner seeks bail in connection with Bishambharpur P. S. Case No,. 19 of 2019, registered for the offences punishable under Sections 341, 323, 302, 504, 34 of the Indian Penal Code.

As per F.I.R. petitioner and other accused persons have assaulted by lathi and rod to the son of the informant, causing injury, later on, he succumbed injuries. Submissions of the learned counsel for the petitioner is that there is counter case also. No specific allegation has been attributed against the petitioner and thought it is alleged that allegation of assault by three persons, but only two injuries were found on the person of the deceased. He is in custody since 09.04.2019.

Having heard both sides, considering the submissions, made above, this application is allowed. Let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-X, Gopalganj, in connection with Bishambharpur P. S. Case No. 19 of 2019 with condition that he has to co-operate in disposal of the trial.
