The petitioner apprehends his arrest in Bettiah Muffasil P.S. Case No.258 of 2018, registered under Sections 366A and 34 of the Indian Penal Code and under Section 8 of the POCSO Act.

The petitioner is alleged to have kidnapped the victim but the victim appeared and made her statement under Section 164 Cr.P.C. and she disclosed that she fell in love with the petitioner and she fled away with the petitioner and remained at the house of the friend of the petitioner. The victim denied the factum of her kidnapping.

Taking into consideration the fact that the victim herself denied the factum of her kidnapping, let petitioner,

Patna High Court CR. MISC. No.60023 of 2019(2) dt.26-09-2019 2/2 above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 1st-cum-Special Judge, West Champaran, Bettiah in connection with Bettiah Muffasil P.S. Case No.258 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
