Having regard to the nature of controversy i.e. construction of a road over the private land of the petitioners by private persons and the State respondents having categorically denied that they have made any construction of road over the private land of the petitioners, the Court is not inclined to entertain this writ petition. The petitioners are well advised to approach the competent Civil Court for common law remedy if there is any dispute as to construction over private land of the petitioners by private parties.
