JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 414 of the Indian Penal Code and 25(1B)a, 26 of the Arms Act.
Petitioner is in jail custody since 18.7.2019 on the accusation that he was caught by the police while he was going on a motorcycle and on being searched, one pistol and three live cartridges were recovered from his possession. Submission on behalf of the petitioner is that the present case is a concocted case due to family dispute. To fortify his submission learned counsel of the petitioner submits that the full-brother of the petitioner has been made seizure list witness. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (M) P.S.
