====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 23-10-2019 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek bail in a case for the offence registered under Sections 341, 323, 504, 307/34 of the IPC. Later on, Section 302 of the IPC was also added. The prosecution story, in brief, is that the wife of Munna Bind was taken by her mother and brother against his will to attend a marriage in accused Jaibabu Bind's house. When Munna Bind alongwith the informant Suresh Bind and other family members including the deceased Chandeshwar
Patna High Court CR. MISC. No.59220 of 2019(2) dt.23-10-2019 2/3 Chaudhary, went to Jai Babu Bind's place to get his wife Chinta Devi, the petitioners herein started abusing them and soon started hitting them with heavy wooden sticks injuring the victim, his wife Usha Devi and Munna Bind on their head. As a result of the injuries, Chandeshwar Chaudhary died during course of his treatment and hence the present F.I.R. It has been submitted by learned counsel for the petitioners that the petitioners are languishing in custody since 30.05.2019. The petitioners have got no criminal antecedent. The petitioners have falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners.
General and omnibus allegation has been made against the petitioners. No specific injury is attributed against the petitioners. Except for this, there is no substantive evidence to suggest the implication of the petitioners in the present case. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M.,
