2. Petitioner seeks regular bail in connection with Jamui P.S. Case No. 262/ 2024 dated 06.05.2024 registered for the offence(s) punishable under Section(s) 302, 201 and 120B of the I.P.C.

3. The main submissions advanced by learned counsel for the petitioner are that the petitioner is not named in the F.I.R. and in respect of petitioner's involvement the prosecution is mainly relying upon the confessional statement of co-accused, Ram Prakash Yadav which has got no evidentiary value and further, even if this statement is believed to be true even then it does not appear that the alleged occurrence was committed in a planned manner and the same can be deemed to have been taken place in spur of the moment on account of some dispute having arisen due to the sale of maize (Bhutta) by the victim to the customers, including the petitioner. It is further submitted that petitioner has fair and clean antecedent and he has been

4. Though learned APP for the State opposed the bail prayer of the petitioner but fairly accepted that there is no direct evidence against the petitioner except the confessional statement of co-accused, Ram Prakash Yadav.

Having regard to the facts and circumstances of this case as well as the above submissions and mainly the petitioner's fair and clean antecedent and completion of investigation against him and also the fact that in respect of the petitioner's involvement in the alleged crime the prosecution is mainly relying upon the confessional statement of co-accused, in my opinion, it is a fit case for grant of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Jamui P.S. Case No. 262 of 2024 on furnishing bail bond of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
