JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is seeking regular bail in Sarai P.S. Case No. 99/2017 registered under Sections 448, 384 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the F.I.R. is against unknown, the petitioner has been falsely implicated and the confessional statement has been extracted from him by police. The only fact which has gone against the petitioner is said to be a SIM card which was once upon a time used in his mobile which has been recovered from his possession. He further submits that the petitioner has no criminal antecedent. Learned A.P.P. for the State opposed the prayer for regular bail.

No.44530 of 2017 (2) dt.20-09-2017 2/2 Considering the facts and circumstances of the case as also the clean antecedent of the petitioner, as stated in paragraph 3 of the application, let the petitioner, namely, Ajit Kumar, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIII, Hajipur in connection with Sarai P.S. Case No. 99/2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
