2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 324, 302, 504/34 of the Indian Penal Code .

3 . As per F.I.R., this petitioner along with 11 other named accused persons committed murder of the grandson of informant by inflicting knife blow .

4. Learned counsel for the petitioner submits that specific accusation of inflicting knife injury is against coaccused Awadh Kishor Paswan and Shivam Kumar. As per the post-mortem report, deceased sustained injury of sharp cut object and cause of death was haemorrhage and shock leading to CR failure . Allegation of assault against petitioner is general

Patna High Court CR. MISC. No.67262 of 2024(2) dt.27-09-2024 2/2 and omnibus. Similarly situated co-accused persons have already granted bail by this Court vide order dated 13.08.2024 in Cr. Misc. No. 46620 of 2024 . Petitioner claims clean antecedent.

5 . Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Sitamarhi in connection with Suppi P. S. Case No. 315 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
