19-09-2017 Heard Sri Birendra Kumar, learned counsel for the petitioner and Sri Arun Kumar Pandey, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 16-07-2017 in Turkauliya P.S. Case No. 425 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that on an allegation of recovery of about 6 liters of Indian make foreign liquor from a Bathan, which was in joint possession, the petitioner has been made accused. Considering the nature of accusation, clean antecedent and period of custody, let the petitioner namely Rahul Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge of Excise at Motihari in connection with Turkauliya P.S.
