2. The petitioner seeks bail in connection with R.S Janjharpur P.S.Case No. 46 of 2025 registered for the offence punishable under Sections 80(2)/3(5) of BNS.
3. As per the prosecution case, the petitioner is husband of the deceased. He is alleged to have tortured and killed the deceased.
4. Learned counsel for the petitioner submits that the sister of the informant has committed suicide and a child born out of the wedlock is staying with the family of the petitioner. The petitioner is in custody since 06.06.2025.
5. The learned APP vehemently opposes the prayer for
Patna High Court CR. MISC. No.64086 of 2025(2) dt.10-09-2025 2/2 bail.
6. This Court has considered the submissions of the parties and has examined the post mortem report. There is no anti mortem injuries. This application is allowed.
7. Let the above named, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st class, Jhanjharpur/ concerned court below in R.S.Jhanjharpur P.S.Case No. 46 of 2025.
8. As a condition of this order, the court below, before accepting the bail bonds of the petitioner shall verify the fact that whether the child of the petitioner is staying with the family of the petitioner or not. The bail bonds of the petitioner shall only be accepted if it is found that the child of the petitioner is staying with the family of the petitioner.
