The petitioner apprehends his arrest in connection with Bodh Gaya P.S. Case No. 229 of 2019 registered for offence punishable under sections 498(A) of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.
It is a case of matrimonial dispute. The petitioner is the husband of informant Kamla Devi, who levelled allegation of torture for non-fulfillment of dowry demand and also levelled allegation that the petitioner has illicit relation with his Bhabhi .

No.59130 of 2019(6) dt.05-01-2022 2/3 The learned counsel for the petitioner has submitted that due to rigid and rude behaviour of the informant, the matrimonial discord aggravated. The petitioner has filed a divorce petition but the same, as per the submission of the learned counsel for the informant, has been dismissed. The effort for amicable settlement was taken and the matter was referred to the Patna High Court Mediation Centre. The report dated 21.12.2021 of Mediation Centre, Patna High Court is available with the record. The Mediator has reported that the parties have failed to settled their dispute through mediation.
The learned counsel for the informant has submitted that the informant is not ready for one time settlement, as she is willing to reside with her husband.
All the efforts for amicable settlement have been failed. It appears that the restitution of matrimonial relation as of now has become difficult.
In such circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in
Patna High Court CR. MISC. No.59130 of 2019(6) dt.05-01-2022 3/3 connection with Bodh Gaya P.S. Case No. 229 of 2019, subject to condition as laid down under section 438(2) Cr. P.C. The learned Trial Court shall take every endeavour to dispose of the case as early as possible.
