2. The petitioners apprehend their arrest in a case registered for the offence under Sections 191(2), 191(3), 190, 324(4), 305(1), 125(1), 125(2), 126(2), 115(2), 117(2), 118(2), 109, 352 and 351(2) of the Bhartiya Nyaya Sanhita.

3. As per F.I.R., 36 named persons including these two petitioners sneaked into the house of informant and stole ornaments worth Rs. 2 Lakhs and cash of Rs. 45,000/- and when informant and his family members protested, all the accused persons assaulted them by means of brick, sword and iron rod.

4. Learned counsel for the petitioners submits that as per F.I.R. itself, specific accusation of assault is against other

Patna High Court CR. MISC. No.63442 of 2025(2) dt.15-09-2025 2/2 co-accused persons. So far as these two petitioners are concerned, there is general and omnibus allegation. Some of the similarly situated co-accused persons have already been granted bail by co-ordinate Benches of this Court, vide orders annexed at Annexure 2 series. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case No. 192 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
