Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a) and 37 of the Bihar Excise Act and Sections 272, 273, 341, 353, 504 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that shop of Anil was raided and he was apprehended but Anil attacked the informant with a knife but informant managed to save himself and while the police was taking Anil to the police station when crowd gathered and abused and pushed the police personnels with a view to release Anil, but the police managed to take Anil to the police station.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case with general and omnibus allegation when petitioner admittedly is a person with clean antecedent.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Harsidhi P.S. Case No. 174 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
