JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-08-2018 Heard Dr. Anshuman, learned counsel appearing on behalf of the petitioner and the learned counsel for the State. This M.J.C. has been filed for initiation of contempt proceeding against the respondents for non-compliance of the order dated 09.10.2017 passed in CWJC No.4701 of 2014. I find that in pursuance of the order dated 09.10.2017, by which the dismissal of the petitioner was set aside, the petitioner joined and his joining has been accepted but no salary is paid to the petitioner.

I find that the order of termination of the petitioner was set aside and the petitioner has already joined, therefore, there is no willful disobedience of the order dated 09.10.2017 passed in CWJC No.4701 of 2014.

Patna High Court MJC No.434 of 2018 (3) dt.08-08-2018 Accordingly, this M.J.C. petition is dismissed. If the petitioner so aggrieved, he may file fresh writ petition.
