The petitioner is languishing in custody in a case registered for the offences punishable under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the bag of the informant containing cash of Rs. 2,60,000/- was robbed by the three unknown criminals.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was not

Patna High Court CR. MISC. No.65594 of 2022(2) dt.27-02-2023 2/2 apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has still not been put on T.I.P. The petitioner is languishing in custody since 15.02.2022. Moreover, similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 20.09.2022 passed in Cr. Misc. No. 36155 of 2022. In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, East, Muzaffarpur in connection with Sakra P.S. Case No. 430 of 2021.
