2. The petitioners have preferred this application for grant of regular bail in connection with Kanti P.S Case No. 247/2025 dated 23.05.2025 registered for the offence punishable u/s 309(4) of the B.N.S.
3. As per the prosecution case, three unknown
Patna High Court CR. MISC. No.63175 of 2025(3) dt.30-10-2025 2/3 miscreants riding on motorcycle are alleged to have come and parked it in front of the shop of the informant, thereafter, they looted Rs. 15-16 lakhs kept in the safe and drawer, on the point of pistol.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners are not named in the FIR. The name of the petitioners have sprung up during the course of investigation. The other co-accused person has been granted regular bail by this court vide order dated 22.09.2025 passed in Cr. Misc. No. 62892/2025. Nothing has been recovered from the possession of the petitioners. The petitioners in Cr. Misc. No. 63859 of 2025 are ladies who are wife of Sikindra Sahni and Ramesh Sahni and during the course of investigation some mobile numbers were identified and from the CDR/CAF it transpired that one of the mobile phone was being operated by the husband of Rekha Kumari and he had made several conversations with Ratnesh. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 09.06.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners. It is further submitted that Rs. 30,000/- was recovered from the possession of the petitioner (Ratnesh Sahni).

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, (West) Muzaffarpur, in connection with Kanti P.S Case No. 247/2025, with the conditions:- (i). The petitioner (Ratnesh Sahni) is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner (Ratnesh Sahni) is liable to be cancelled.
(ii). The court below shall verify the criminal antecedent of the petitioners and at any stage, if it is found that the petitioners have concealed their criminal antecedent, the court below shall take step for cancellation of bail bonds of the petitioners. However, the acceptance of bail bonds in terms of the above mentioned order shall not be delayed for purpose of or in the name of verification.
