JUSTICE JYOTI SARAN ORAL ORDER 12-08-2015 The petitioners in substance seek a direction to the Managing Director, Bihar State Co-operative Marketing Union Ltd. (hereinafter referred to as 'the BISCOMAUN') to refund the deducted amount of provident fund recovered from their respective salaries against pending loans.

The petitioners though rely upon an order of this Court passed in C.W.J.C. No. 4951 of 2011 to question the decision of the Managing Director dated 25.3.2010 placed at Annexure-1 to the writ petition but in view of the law laid down by the Special Bench of this Court in the decision reported in 2014 (1) PLJR 695 (The Organizer, Dehri C.D. & C.M. Union Ltd. Vs. The State of Bihar & Ors.), no writ would lie against the cooperative society and even though Mr. R.S. Pradhan representing the Employees Provident Fund Commissioner while criticizing the action so taken by the Managing Director, BISCOMAUN has

Patna High Court CWJC No.1764 of 2014 (4) dt.12-08-2015 3/3 submitted that a show cause notice has also been issued to the Managing Director by the Department as to why exemption so granted to them be not cancelled but yet considering the nature of relief so prayed, this Court can only dispose of the writ petition reserving liberty to the petitioners to take recourse to such other remedy for redressal of their grievance as may be available to them in law.
