The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 420 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner took Rs. 25,000/- from the informant for operation of Gall bladder of his wife, as there was stone in the Gall bladder, but he did not operate her rather only put stitch on her abdomen. It is submitted that instant case has been lodged after lapse of seven years of the allege occurrence. Petitioner is a doctor and is running a nursing home and he never operated the

Considering the facts aforesaid and the long delay in lodging of the FIR, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist Class, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S. Case No. 233 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
