2. The petitioner has preferred this application for grant of regular bail in connection with Kalyanpur P.S. Case No. 48 of 2025 dated 12.02.2025 registered for the offences punishable u/ss 303(2), 317(2) and 3(5) of B.N.S.
3. As per the prosecution case, on February 11, 2025, at about 11:30 p.m., the informant, Jadolal Bhagat, and his family went to sleep in their room, they heard some sound outside the door. The informant peeked through the window of his house and saw two men taking the informant's scooter, bearing Regd No. AR01N4874. Upon hearing the informant's scream, neighbours and villagers rushed to the scene. The accused left the scooter and started running. One person was

No.63099 of 2025(2) dt.24-09-2025 2/3 apprehended by villagers and the informant who disclosed his name as Dheeraj Kumar and the name of the person who managed to escape as Mantu Yadav. The informant dialed 112 and informed the police about the incident and then the apprehended person was handed over to the police
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused namely, Dhiraj Kumar. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has five criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 31.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Motihari, East Champaran in connection with
