Petitioner is an accused in a case registered for the offence punishable under sections 302/34 of the IPC. The prosecution case, in brief, is that on the date of occurrence at about 06:00 PM when the deceased was bringing his sand and bamboo at his place for construction of a house, the petitioner called the deceased and by the help of other slit the throat of the deceased.
Learned counsel for the petitioner, while refuting the allegation, submits that the petitioner has falsely been implicated in this case due to land dispute. Nothing incriminating material has come against the petitioner during investigation to connect him with the offence. Petitioner has got no criminal antecedent and he is in custody since 05.02.2019.

No.69068 of 2019(3) dt.29-01-2020 2/2 In view of the nature of allegation against the petitioner and even the postmortem report has also confirmed the injury stated by the informant, the prayer for bail is refused. Accordingly, the present application for bail is dismissed.
