JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 13-03-2015 The reason for non- selection of the petitioner is obvious after reading of paragraphs 11 and 12 as well as having a look at Annexures D and E of the counter affidavit. The stand of the respondents is that it is a case of mis-declaration of category by the petitioner for selection on the post of constable. He did not belong to the Home Guard category still in his application he made a declaration that he belong to Home Guard category. Since there are different kind of parameters which is available for category belonging to Home Guard and petitioner does not belong to the same then the reason for rejection of his candidature is obvious.

Patna High Court CWJC No.1750 of 2014 dt.13-03-2015 2/2 Way back on 25.3.2014, after service of counter affidavit counsel for the petitioner took time to file a rejoinder, which has not been done in almost a year. In view of the same, there is no rebuttal of the position so indicated in the counter affidavit. Writ is dismissed.
