====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 21-09-2017 Heard Sri Hans Lal Kumar , learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Tariyani P.S. Case No.124/2017 registered for the offence under Sections 30(A) and 33 of the Bihar Prohibition and Excise Act,2016, has prayed for grant of bail, in the event his arrest or surrender. It was submitted by learned counsel for the petitioner that the petitioner's name in the case has surfaced on the basis of confessional statement of one of the accused, namely Shambhu Mahto, from whose possession 750 ml of Indian Make Foreign liquor was recovered and also on his disclosure some more Indian Make Foreign Liquor was recovered. According to learned counsel for the petitioner, save and except confessional statement, there is no material against the petitioner and the

Patna High Court Cr.Misc. No.44133 of 2017(2) dt.21-09-2017 2/2 petitioner is having clean antecedent. This fact has been stated in paragraph-3 of the petition.

Considering the fact that on the basis of confessional statement of one of the accused, the petitioner's name has surfaced as well as clean antecedent, let the petitioner, namely, Md. Bablu, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-I-cumSpecial Judge, Sheohar in connection with Tariyani P.S. Case No.124/2017, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
