The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 504, 506, 341, 323, 436 and 427 of the Indian Penal Code. Allegation against the petitioner along with accused persons were sprinkled petrol and put fire in the house of informant after that many home articles were destroyed. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and the petitioner has been made accused in this case during the investigation. The petitioner is an employee in North Central Railways Department during the occurrence he was on duty, which has been cleared after perusal of the certificate issued by the departmental

Learned APP for the State submits that the petitioner has been made accused during the investigation but he admitted that the police has not interrogated this fact (Annexure-2) it is false or true and police has not mentioned any fact regarding at Annexure-2.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-15th, Patna in connection with Phulwari Sharif P.S. Case No. 774 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
