2. The petitioner is seeking regular bail in connection with Patori Excise P.S. Case No. 96 of 2024 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per prosecution case, there has been recovery of 60 liters of illicit liquor from a motorcycle and the petitioner was apprehended on spot by the police.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing has been recovered from his conscious possession and he has no concern

Patna High Court CR. MISC. No.66776 of 2024(2) dt.26-09-2024 2/2 with the alleged recovery of illicit liquor. The petitioner is a man of clean antecedent. Moreover, he is under custody since 18.08.2024.

5. On the other hand, learned APP for the State has opposed the prayer for bail of the petitioner.

6. Considering the above-mentioned facts and circumstances of the case as well as petitioner having clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court-02, Samastipur in connection with Patori Excise P.S. Case No. 96 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
