This is an application for bail in connection with Excise Case No. 06 of 2017 registered for the offences punishable under Section 30(a) of Bihar Excise Act.
Allegation is of recovery of 212.4 litres of foreign liquor and 320 litres of country made liquor.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and nothing has been recovered from his possession and he is in custody since 10.8.2017 having criminal antecedents.

Having heard both sides and in view of facts and
Patna High Court Cr.Misc. No.43985 of 2017 (2) dt.15-09-2017 2/2 circumstances, this application is disposed of with a direction that once charge has been framed or petitioner completes five months period in custody, whichever is earlier, the court below will release the petitioner on bail to its own satisfaction, if application for bail is filed on behalf of petitioner.
