2. Petitioners apprehends arrest in a case registered for the offence punishable under sections 103 (1) and 3 (5) of BNS.
3 . As per the prosecution case , informant namely, Rekha devi alleged that on 18.06.2024 , all the F.I.R. accused persons including these petitioners came at the house of informant and assaulted husband of informant by lathi and danda due to which he sustained injuries. It is further alleged that during course of treatment, husband of informant died.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.66262 of 2025(3) dt.07-11-2025 2/2 petitioners are innocent and have falsely been implicated in this case . F.I.R. has been lodged after delay of 2 days. No specific allegation of assault is alleged against these petitioners. Doctor has also not disclose the cause of death . During course of investigation , it has came to light that deceased was suffering from several disease .

Learned counsel for the State opposed the prayer for bail and submitted that petitioners are named in the F.I.R. and there is specific allegation against the petitioners that they along with other co-accused persons assaulted husband of informant due to which he died. Postmortem report goes to show that doctor has found external injuries on the person of deceased.
6. Considering the aforesaid facts, nature of accusation and gravity of offence , prayer for pre-arrest bail of the petitioners is rejected.
