Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with NDPS Case No. 147 of 2022 arising out of Kanti P. S. Case No. 366 of 2022 registered for the offences punishable under sections 8(c) and 21(b) of the Narcotic Drugs and Psychotropic Substances Act. As per the prosecution case, 15 gram smack like substance was recovered from the possession of the petitioner

Patna High Court CR. MISC. No.63738 of 2022(2) dt.22-03-2023 2/3 and total 55 gram smack like substance was also recovered from the possession of co-accused Md. Amir Raja in sachets. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No such occurrence as alleged has ever taken palace. Nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner has been dragged in this case at the instance of his enemies. Learned counsel has further submitted that the seized contraband is less than commercial quantity. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 09.06.2022.

Learned A.P.P. for the State has vehemently opposed the prayer of bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Muzaffarpur in connection with NDPS Case No. 147 of 2022 arising out of Kanti P. S. Case No. 366 of 2022 with the condition:-

1. the petitioner is directed to remain physically
