The petitioner seeks bail in a case registered under Sections 394, 412 of the Indian Penal Code.

Allegation is that the accused persons with an intention to kill the informant attacked with a knife, make him wounded and snatched away his money and mobile phone. It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.03.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. He was passing by the place of occurrence at the relevant time. The recovery of the looted article is from the

Patna High Court CR. MISC. No.59248 of 2019(2) dt.19-09-2019 2/2 other co-accused. Nothing incriminating is said to have been recovered from the possession of the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Hajipur Sadar P.S. case No.168 of 2019.
