JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-05-2019 The petitioners have challenged the order of cognizance dated 13.10.2014 passed by the learned Sub-Divisional Judicial Magistrate, Nalanda at Biharsharif in Complaint Case No. 288(C) of 2013 whereby cognizance has been taken under Sections 354, 504, 379 of the Indian Penal Code.

The learned counsel for the petitioners has informed this Court that the trial has begun and one of

Patna High Court CR. MISC. No.8449 of 2015(7) dt.08-05-2019 2/2 the prosecution witnesses has already been examined. Considering the aforesaid change in the stage of the case, this Court is not inclined to interfere with the order taking cognizance.

The Trial Court is only directed to expedite the conclusion of the trial.

The petition is dismissed with the aforesaid observation/direction.
