2. The petitioner is in custody in connection with S.T. Case No. 148 of 2023 arising out of Basnahi P.S. Case No. 260 of 2022 for the offence under Sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per F.I.R, the deceased was killed by unknown criminals.

4. Learned counsel for the petitioner submits that the petitioner is suspected to have participated in killing of the deceased and he is in custody since 25.12.2022. He has further submitted that he has falsely been implicated in this case.

5. Learned counsel for the informant has opposed the

Patna High Court CR. MISC. No.69471 of 2023(2) dt.01-11-2023 2/2 prayer of the petitioner and has submitted that petitioner had threatened the deceased earlier.

6. Considering the fact that there is no material against the petitioner to connect him with the crime, the petitioner, named above, is directed to be released on bail subject to the condition that he will cooperate in the trial and on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Saharsa in connection with S.T. Case No. 148 of 2023 arising out of Basnahi P.S. Case No. 260 of 2022.

7. The petitioner will visit Sonbarsa Police Station on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
