In this case, the petitioner is seeking regular bail in connection with Hisua P.S. Case No. 188 of 2016, registered for the offence under Section 302 of the Indian Penal Code and under Section 27 of the Arms Act.

Allegation has been made that informant namely, Malo Devi, was sleeping along with her husband and children. In the midnight, unknown person came and shot dead her husband. During investigation, after about one and half year, statements have been made by the sons and mother-in-law of the informant and gave description in what manner the present petitioner came to the house of the informant and committed

It has also been recorded in the F.I.R. that the informant has illicit relationship with the present petitioner and on that account, this incident has taken place. Furthermore, Annexure-2 of this bail petition, which is a compromise petition, has been filed by the informant for compromise.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected for the present.
