Petitioners are in custody in connection with Marauna P.S. Case No. 81 of 1998 for the offence under sections 147, 323, 447, 379, 504 and 427 of the Indian Penal Code. Learned counsel for the petitioner would submit that earlier petitioners were granted bail on merit. Their bail bonds were subsequently cancelled on account of lack of pairvi. Considering the fact that petitioners are facing trial under sections 323 and 504 of the Indian Penal Code which is bailable one, the Court is inclined to grant bail to the petitioners,
Patna High Court CR. MISC. No.58771 of 2019(2) dt.30-09-2019 2/2 let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Kamlesh Singh Deu, learned Judicial Magistrate-1st Class, Supaul, in connection with Marauna P.S. Case No. 81 of 1998/G.R. No. 1079 of 1998 subject to the condition that petitioners shall extend full cooperation in early conclusion of the trial. In the event, the petitioners fail to attend the court proceeding on two consecutive dates without any cogent reason, the court below shall be at liberty to cancel their bail bonds.
