====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-10-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in connection with Musarigharari P.S. Case No. 48 of 2019, G.R. No. 753 of 2019 for the offences under Sections 272, 273, 34 of Indian Penal Code and 30(a) of the Bihar Prohibition & Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is carrying business and he has a Kirana Store. The petitioner has no criminal antecedent. In the instant case total 5171.32 ltrs of foreign liquor was recovered from the possession of the petitioner. The petitioner is in custody since 20.07.2019. Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner.

No.60848 of 2019(2) dt.17-10-2019 2/2 Having regard to the quantity of liquor seized, the Court is constrained to impose stringent condition that the petitioner may be enlarged on bail subject to cash deposit of Rs. 1,00,000/- (One Lakh) in the Court below and on deposit of the same, the Court below shall release the petitioner, above named, on bail on furnishing bail bonds of Rs. 1,00,000/- (One Lakh) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Samastipur, in connection with Musarigharari P.S. Case No. 48 of 2019, G.R. No. 753 of 2019. The cash deposit of Rs. 1,00,000/- shall abide by the final outcome of the pending criminal case.
