JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 This is an application for grant of anticipatory bail in connection with Bela P. S. Case No. 210 of 2018, disclosing offences under Sections 376 and 511 of IPC and Section 8 of POCSO Act.

As per F.I.R. petitioner has lifted the informant, who was minor and attempted to commit rape upon her and one Jogendra Mahto reached there and he saved her. Submission of the learned counsel for the petitioner is that few days prior, the petitioner's side has lodged a complaint case against the uncle of the informant and as such, the present case has been lodged.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail by stating that the statement of Jogendra Mahto has been recorded and he has also supported the

Patna High Court CR. MISC. No.58379 of 2019(4) dt.20-11-2019 2/2 prosecution case.

Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail.
