The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341, 323, 504/34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Prosecution case is that the petitioners assaulted the informant with fists and slaps and abused by calling caste name. It is further alleged that on the order of co-accused Santosh Pandey, all the accused persons assaulted the informant.

No.18855 of 2016 (2) dt.03-05-2016 2/2 It is submitted by learned counsel for the petitioners that in the background of land dispute the accusation has been levelled and at earlier point of time also three cases were lodged at the behest of the informant wherein the petitioners are on bail. There is counter version of the occurrence and the petitioners' sides have also received injuries. The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Bhabua SC/ST Case No.14/2016, pending before the learned Judicial Magistrate, 1st Class, Bhabua, Kaimur.

With the above observation, this application is, accordingly, disposed off.
