This application has been filed on behalf of the petitioner for modification of the order dated 02.11.2015 passed in Criminal Misc. No.46754 of 2015 by a Bench of this Court, whereby the petitioner, above named, was granted the privilege of pre-arrest bail in connection with Alam Nagar P.S. Case No.111 of 2014 with certain conditions on surrendering before the trial court within four weeks from the date of receipt of the aforesaid order, with regard to extend the period of surrender of the petitioner, above named, before the trial court in connection with the aforesaid case.

Learned counsel for the petitioner submits that due to non communication of the aforesaid order to the court concerned,

Patna High Court Cr.Misc. No.48951 of 2017 (2) dt.30-10-2017 2/2 the petitioner could not surrender before the trial court within time and prays for extension of period of the surrender of the petitioner, above named, before the trial court in connection with the aforesaid case.

Having regard to the facts and circumstances of the case, let the period of surrender of the petitioner, above named, in connection with the aforesaid case before the trial court be extended for further four weeks from today.

The order dated 02.11.2015 passed in Criminal Misc. No.46754 of 2015 by a Bench of this Court is modified to the aforesaid extent only and this application is, accordingly, disposed of.

Let the copies of this order and the order dated 02.11.2015 passed in Criminal Misc. No.46754 of 2015 by a Bench of this Court be communicated to the court of the Chief Judicial Magistrate, Madhepura, in connection with Alam Nagar P.S. Case No.111 of 2014 forthwith.
