JUSTICE SANJAY PRIYA ORAL ORDER 13-10-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Biraul P.S. Case No. 200 of 2016 instituted for the offence under Sections-302, 304B/34 of the Indian Penal Code.

The petitioner is husband of the deceased.

There is allegation in the written report that the deceased was married with this petitioner in the year, 2013. She was tortured in Sasural because she could not bear child. It is alleged that this petitioner and other accused persons caused her death by burn injury. Learned Sessions Judge has mentioned in the impugned order that in the postmortem report, the doctor has found burn injury, caused by flames of fire and death was due to dehydration and shock as a result of burn injury. It is also apparent from the FIR that the deceased died in her Sasural unnatural death.

In such circumstances, this court is not inclined to grant

Patna High Court Cr.Misc. No.46988 of 2017 (3) dt.13-10-2017 2/2 anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.

The petitioner is directed to surrender in the court below and seek regular bail which will be considered on its own merit without being prejudiced by this order.
