JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 147 of Rail Act and Section 47(A) of the Excise Act.

In huge quantity, Mahua liquor were recovered from break-van of a passenger train. So far as petitioner is concerned, he as well as another accused were caught by the informant and other officials while they were trying to flee from the above stated break-van of train. Petitioner is in jail custody since 13.03.2016 and does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, this aspect of the
